About InnerWhim Studio

InnerWhim Studio, LLC (“InnerWhim Studio,” “we,” “us,” or “our”) is a Wisconsin limited liability company based in Dane County. We are a studio creating original illustrations, thoughtfully designed products, digital creative resources, and select creative services.

As our studio grows, our products and services may evolve, but our commitment to thoughtful design, quality, and customer care remains the same.

Eligibility

By using this website, you confirm that you are at least 18 years old or are using this website under the supervision of a parent or legal guardian. If you are under 18, your parent or legal guardian must review and agree to these Terms on your behalf.

Product availability, specifications, and descriptions may change at any time without prior notice. We reserve the right to discontinue any product or service.

Product Descriptions & Color Accuracy

We make every effort to accurately describe and represent our products. However, we cannot guarantee that colors, textures, or other visual elements will appear identically on all devices and monitors.

Because colors may appear differently on individual monitors, phones, tablets, and printers due to screen calibration, brightness settings, and device specifications, slight variations between what you see on screen and the finished physical product are normal and do not constitute a defect or grounds for return unless the variation is substantial.

Print-on-Demand Products

Many physical products sold through InnerWhim Studio are professionally produced and fulfilled by trusted third-party production and fulfillment partners.

By placing an order for a print-on-demand product, you acknowledge that:

• Products may be made specifically for your order and produced after your purchase.

• Production and shipping times may vary depending on the product, production partner, and destination.

• Estimated delivery dates provided at checkout are estimates and are not guaranteed.

• Delivery times may be affected by production schedules, carrier delays, holidays, weather, customs processing, and other circumstances beyond our reasonable control.

• InnerWhim Studio selects third-party production and fulfillment partners but does not directly control their production processes, quality-control procedures, carrier operations, or shipping methods.

Print-on-demand products are generally not eligible for return or exchange except in cases of damage, defects, incorrect items, or manufacturing errors, as further described in our Refund Policy.

If something isn't right with your order, please contact us so we can review the issue and, when appropriate, work with our production or fulfillment partner toward a resolution.

Digital Products

Digital products are delivered electronically, generally through a download link or other electronic delivery method. No physical product will be shipped unless expressly stated otherwise.

Digital purchases may be processed, fulfilled, and delivered through third-party digital commerce or payment providers. Information about pricing, taxes, payment, and delivery may also be presented during checkout by the applicable provider.

Unless otherwise stated, digital products are licensed, not sold. Your use of a digital product is governed by the applicable license associated with that product, such as our Personal Use License Agreement or Annual Helping Others License Agreement. By purchasing or using a digital product, you agree to comply with the applicable license terms.

Professional, commercial, educational, therapeutic, or other uses beyond the permissions granted under the included license may require a separate license or written agreement. If you are unsure whether your intended use requires a different license, please contact us for guidance.

Customers are responsible for having appropriate software, hardware, printers, materials, and other equipment necessary to access, print, or use purchased digital products.

Because of the nature of digital products, digital purchases are generally non-refundable once delivered or accessed. If you experience a technical issue, receive an incorrect file, or encounter another problem with your purchase, please contact us. We will review the circumstances and provide assistance or another appropriate resolution when warranted and as further described in our Refund Policy.

Pricing, Payment & Taxes

All prices are listed in U.S. dollars unless otherwise stated.

Applicable sales taxes, VAT, or other transaction taxes may be calculated and collected at checkout where required. Depending on the product and checkout method, taxes may be calculated, collected, and/or remitted by a third-party commerce or payment provider in accordance with its applicable responsibilities.

Payment must be successfully processed before an order is fulfilled. Available payment methods are displayed at checkout and may be processed through third-party payment processors or commerce providers.

We reserve the right to change prices, products, promotions, discounts, and product availability at any time without prior notice. Pricing or technical errors may be corrected, and we reserve the right to cancel an order placed at an incorrect price.

Order Acceptance & Confirmation

When you place an order, you may receive an order confirmation acknowledging receipt of your order. Receipt of an order confirmation does not necessarily constitute final acceptance or a commitment to fulfill the order.

InnerWhim Studio reserves the right to accept or decline an order, in whole or in part, for reasons including suspected fraud, unauthorized payment methods, pricing or technical errors, product availability, payment-processing issues, violations of these Terms or our policies, quantity limitations, or circumstances that make fulfillment impractical, unlawful, or impossible.

If we cancel an order after payment has been successfully processed, we will issue an appropriate refund to the original payment method within a reasonable period.

Shipping & Delivery

Shipping estimates and delivery timeframes provided on our website or at checkout are provided in good faith but are estimates and cannot be guaranteed.

Delivery may be affected by third-party carriers, customs processing, weather events, natural disasters, labor disruptions, supply-chain issues, carrier changes, and other circumstances beyond our reasonable control.

You are responsible for providing a complete and accurate shipping address. If an incorrect or incomplete address causes a delivery problem, we will make reasonable efforts to assist, but additional costs or replacement may not always be available.

For international orders, customs duties, import taxes, fees, or other charges may apply depending on the destination, fulfillment location, and applicable laws. Unless otherwise stated at checkout or required by applicable law, customers are responsible for charges imposed by the destination country that are not collected as part of the purchase.

Questions concerning a shipment that is lost, damaged, delayed, or otherwise affected while in transit will be handled in accordance with our Refund Policy and applicable law.

Returns & Refunds

Our separate Refund Policy provides information regarding returns, replacements, refunds, damaged or defective products, manufacturing errors, cancellations, shipping issues, and digital purchases.

The Refund Policy is incorporated into these Terms by reference and forms part of the agreement governing purchases from InnerWhim Studio.

Nothing in these Terms or our Refund Policy limits any refund, replacement, cancellation, or other consumer right that cannot legally be excluded or limited.

Creative Services

InnerWhim Studio may offer custom creative or design services from time to time.

Such services may be subject to a separate proposal, scope of work, contract, estimate, order form, or other written agreement addressing matters such as project scope, fees, payment terms, revisions, timelines, deliverables, intellectual property rights, and cancellation.

If a separate written agreement governing creative services conflicts with these Terms, the separate agreement will control with respect to those services.

Intellectual Property

All artwork, illustrations, character designs, graphics, logos, written content, website content, digital resources, photographs, and other original creative works available through InnerWhim Studio (collectively, “Content”) are owned by InnerWhim Studio or used with appropriate permission and are protected by applicable copyright, trademark, and other intellectual property laws.

Purchasing a physical product containing InnerWhim Studio artwork or design does not transfer ownership of the copyright, trademark, or other intellectual property rights in the underlying creative work. The purchaser receives ownership of the physical item, subject to applicable law, but not ownership of the underlying intellectual property.

Rights associated with digital products are governed by the applicable license agreement, such as our Personal Use License Agreement.

Unless permitted by an applicable license, separate written agreement, or applicable law, you may not copy, reproduce, redistribute, resell, publicly display, modify, create derivative works from, commercially exploit, or otherwise use InnerWhim Studio Content.

Acceptable Use of Website

You agree to use this website only for lawful purposes and in accordance with these Terms.

You may not:

• Copy, reproduce, redistribute, or resell copyrighted materials beyond permissions expressly granted by an applicable license.

• Use our artwork, designs, or other Content for unlawful, harmful, fraudulent, or unauthorized purposes.

• Interfere with or compromise the operation, security, or integrity of the website or related systems.

• Misrepresent your identity, impersonate another person, or attempt fraudulent transactions.

• Introduce viruses, malware, harmful code, or other malicious software.

• Attempt unauthorized access to the website, customer accounts, or related systems.

Artificial Intelligence & Machine Learning

Unless expressly authorized by InnerWhim Studio in a separate written agreement, our artwork, illustrations, character designs, digital resources, written content, and other original creative Content may not be uploaded to, incorporated into, or used to train artificial intelligence systems, machine-learning models, datasets, image-generation systems, or similar technologies for purposes including training algorithms, reproducing creative works, or generating derivative works.

This restriction applies to both commercial and non-commercial use.

​

Removal or circumvention of copyright notices, watermarks, signatures, trademarks, or other proprietary identifiers is also prohibited except as expressly authorized.

Customer Accounts

Where our website allows customers to create an account, customers are responsible for providing accurate information and maintaining the confidentiality and security of their login credentials.

You are responsible for activity conducted through your account and should notify us promptly if you believe your account has been accessed without authorization.

We reserve the right to suspend or terminate accounts used fraudulently, unlawfully, or in violation of these Terms.

Limited Warranty & Disclaimer

For physical products, InnerWhim Studio intends to provide products free from material manufacturing defects under normal intended use. If you receive a damaged, defective, or incorrectly produced product, please contact us as described in our Refund Policy.

Except for warranties, guarantees, or other consumer rights that cannot legally be excluded or limited, the website and its content are provided on an “as is” and “as available” basis.

Nothing in these Terms is intended to waive or limit consumer rights or warranties that cannot legally be waived or limited under applicable law.

Any dispute will be handled in accordance with applicable law and the jurisdiction and venue requirements that legally apply to the particular dispute.

Severability

These Terms, together with our Refund Policy, Privacy Policy, applicable license agreements, and any other policies or agreements expressly incorporated by reference, constitute the agreement governing your use of this website and purchases from InnerWhim Studio.
